These Terms of Service govern your use of the ECHO Films website and our film production services. By accessing this site or engaging our services, you agree to these terms.
1. Acceptance of Terms
By accessing and using the ECHO Films website (the "Site"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this Site. We reserve the right to modify these terms at any time, and your continued use of the Site following any changes constitutes acceptance of those changes.
2. Services
ECHO Films provides film production, cinematography, post-production, documentary, and brand content services. All services are subject to a separate project agreement that will outline scope, deliverables, timeline, and fees. The terms on this page apply generally to the use of our website and do not replace or override the terms of any specific project contract.
3. Intellectual Property
All content on this Site — including but not limited to text, graphics, logos, images, video clips, audio clips, digital downloads, and data compilations — is the property of ECHO Films or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without prior written consent.
4. Project Deliverables & Ownership
Upon full payment, clients receive ownership of final deliverables as specified in their project agreement. Unless otherwise stated in writing, ECHO Films retains the right to use completed work for portfolio, promotional, and award submission purposes. Raw footage, project files, and unused material remain the property of ECHO Films unless explicitly transferred in the project agreement.
5. Payment Terms
Project fees are outlined in the individual project agreement. A deposit of fifty percent (50%) is required before production begins, with the remaining balance due upon delivery of final files. Late payments may incur a monthly interest charge of one and a half percent (1.5%). ECHO Films reserves the right to pause or halt work on any project with outstanding payments.
6. Cancellation & Refunds
Cancellations must be submitted in writing. If a project is cancelled before production begins, the deposit will be refunded minus a fifteen percent (15%) administrative fee. If cancellation occurs during production, the client is responsible for all costs incurred up to the date of cancellation. No refunds are available for completed deliverables.
7. Limitation of Liability
ECHO Films shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Site, any conduct or content of any third party on the Site, or any content obtained from the Site.
8. Third-Party Links
Our Site may contain links to third-party websites or services that are not owned or controlled by ECHO Films. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that ECHO Films shall not be responsible for any damage or loss caused by or in connection with the use of any such content.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Site shall be resolved in the courts located in Portland, Oregon.
